Nowadays, rising dissatisfaction with arbitration, as the most commonly used way of agreed dispute resolution in the Oil and Gas industry, has meant that parties are opting for Alternative Dispute Resolution methods, despite its mostly non-binding nature. In light of these facts, popularity of mediation as an arranged way of dispute resolution in Oil and Gas industry is rising, perhaps not as a single tool, but as part of a multi-tier agreed dispute resolution.
In this book, mediation, will be compared with litigation to answer the question of whether the industry players find mediation, as an arranged way of dispute resolution, preferable to litigation, taking into account both processes’ pros and cons. This will be followed by a discussion of favourable grounds for mediation to become one of the major tools to resolving the O&G industry disputes.
In doing so, particular attention will be paid to relevant case law, scenario situations, standard contract clauses, dispute resolution clauses for mediation process.
